The State Duma Committee on Economic Policy recommended rejecting the bill on mandatory labeling of glass containers and introducing a ban on the production and circulation of alcohol with an alcohol content of over 28% in plastic bottles.
The document, introduced by a group of senators and adopted in the first reading in January 2021, provides for the mandatory application of a designation (stamp) to glass consumer containers produced in Russia, allowing the identification of its manufacturer, and the entry of information about it into the federal register of designations.
At the same time, the bill introduces a ban on the production and circulation of alcoholic products with an ethyl alcohol content of more than 28% in polymer consumer packaging. An exception is made only for alcohol imported into Russia under the customs procedure of duty-free trade or produced for export from the Russian Federation, as well as in containers of no more than 50 milliliters, since it is in demand on domestic airlines.
The Committee draws attention to the fact that the requirements for consumer packaging contained in the bill are not included in the technical regulations of the Customs Union (CU) “On the safety of food products”, “Food products regarding their labeling”, “On the safety of packaging”. In this regard, the bill may conflict with the provisions of paragraph four of part 3 of article 7 of the federal law “On technical regulation”, according to which product requirements not included in technical regulations cannot be mandatory.
In addition, from January 1, 2024, the technical regulation of the Customs Union “On the safety of alcoholic products” comes into force, which “does not contain the requirements for glass consumer containers proposed by the bill, and therefore the expediency of adopting the bill loses its relevance,” the committee’s conclusion notes.
