Industry about the need to restore state control and supervision. joint meeting

Dear colleagues!

On December 13, 2022, a joint meeting of the RSPP Committee on Licensing and Control and Supervisory Activities, the RSPP Committee on Industrial Policy and Technical Regulation and the RF CCI Committee on Technical Regulation was held. The issues of restoring state control (supervision) over the fulfillment of the requirements of 13 technical regulations, as well as over products included in the unified lists of products subject to mandatory certification and declaration of conformity, approved by Decree of the Government of the Russian Federation of December 23, 2021 No. 2425, were discussed.

The meeting was attended by the RSPP Vice President Alexander Varvarin, Deputy Co-Chair of the RSPP Committee on Industrial Policy and Technical Regulation, Chairman of the Council for Technical Regulation and Standardization under the Ministry of Industry and Trade of Russia Andrey Lotsmanov, Deputy Chairman of the RSPP Committee on Permitting and Supervisory Activities Yulia Shabala, Chairman RF Chamber of Commerce and Industry Committee for Technical Regulation of Standardization and Product Quality Sergey Pugachev.

Federal executive authorities were represented by Director of the Department of State Policy in the Sphere of Licensing, Supervisory Activities, Accreditation and Self-Regulation of the Ministry of Economic Development of Russia Alexander Vdovin, Director of the Department of State Policy in the Field of Technical Regulation, Standardization and Uniformity of Measurements of the Ministry of Industry and Trade of Russia Vyacheslav Burmistrov, Deputy Head of Rosstandart Alexander Kuzmin and Assistant to the Deputy Chairman of the Government of the Russian Federation - Minister of Industry and Trade D.V. Manturov Alexey Mednikov.

The Association "StekloSouz" of Russia was represented at the meeting by Talakuev Nikolai Pavlovich, Director of the Department of Technical Regulation and Quality Control. In his speech, he expressed concern about the issue of state supervision in the field of mandatory certification and standards for industrial products in the glass industry. Nikolai Pavlovich, together with the rest of the meeting participants, took an active part in the formation of the final document.

The meeting was also attended by heads of sectoral business associations - manufacturers of pipe, electrical cable, electrical products, heating radiators, cement.

The meeting participants discussed in detail the need to restore state control and supervision over the requirements of 13 technical regulations of the Eurasian Union and Government Decree No. 2425 in order to protect the interests of bona fide manufacturers and businesses in Russia and the EAEU countries, as well as protect the market from low-quality, counterfeit products.

The results of the meeting are commented by Andrey Lotsmanov, Deputy Co-Chairman of the RSPP Committee on Industrial Policy and Technical Regulation, Chairman of the Council for Technical Regulation and Standardization under the Ministry of Industry and Trade of Russia:

“Issues that were discussed at the meeting have acquired special relevance today. Many industry associations have been making proposals for the restoration of state control and oversight for a number of years. The goal is to protect the Russian market, the interests of conscientious Russian manufacturers from falsified, as a rule, foreign products. Previously, Government Decree No. 982 was a barrier to such products, the effect of which also had a positive effect on attracting foreign investment to our country, and hence the opening of production facilities and the creation of new jobs.

For a number of years, decisions on the introduction of mandatory certification, mandatory standards and state supervision were taken by the State Commission for Combating Illicit Circulation of Industrial Products after a comprehensive analysis of the impact of the introduction of mandatory requirements on product safety.

However, the adoption of satellite law No. 170-FZ in 2021 led to the fact that state supervision over the implementation of the requirements of 13 technical regulations and Government Decree No. 982 was actually canceled. This led to a sharp increase in the turnover of counterfeit products and a reduction in production and jobs at the enterprises of bona fide manufacturers. Specific figures and facts illustrating this situation were presented at the meeting by representatives of industry associations of business.

RSPP submitted a proposal on the need to restore state control to Deputy Prime Minister D.V. Manturov in June of this year, and in October this issue was considered at a meeting of the Bureau of the Board of the RSPP. Members of the Bureau of the Board of the RSPP - the heads of the largest companies in Russia unanimously supported the need to restore state control and supervision. The consolidated position of the RSPP has been sent to the Government of the Russian Federation.

When considering the issues of abolishing or introducing state supervision and control, only the aspect of increasing the administrative burden on business is taken into account, but it is also necessary to take into account the issues of protecting markets and national industry, because conscientious manufacturers, in the absence of control and supervision, cannot compete with counterfeit manufacturers.

The main goal of the joint meeting of the committees of the RSPP and the Chamber of Commerce and Industry was to convey to the Government, the leadership of the Ministry of Industry and Trade, the Ministry of Economic Development, Rosstandart the position of industry representatives on this issue. The heads of large industry associations who spoke at the meeting were unanimous in their opinion: the lack of state control and supervision is an obstacle to honest business, creates conditions for the penetration of low-quality, counterfeit products into the market. In addition, such products - and this was also repeatedly discussed by the participants of the meeting - pose a threat to health, and sometimes to people's lives".

The meeting participants approved the draft Resolution, which will be sent to the Government, interested ministries and departments.
