On supplementing the unified list of products

Dear colleagues, good afternoon!

The Association "StekloSouz" of Russia informs you that the Ministry of Industry and Trade of Russia is currently working on supplementing the products of the building materials industry with a single list of products subject to mandatory certification and a single list of products, the conformity of which is confirmed in the form of a declaration of conformity in order to eliminate the problem the presence of a high proportion of counterfeit construction products in terms of the following types of products:

- sealing materials (construction sealants);

- products made of polymer composites for construction purposes (polymer composite reinforcement; flexible polymer composite ties; polymer composite pultruded profiles; glass composite pipes and fittings, including those for uranium mining; culvert pipes made of polymer composites; polymer composite pipes and fittings for in-field pipelines; pipes and parts of pipelines made of fiber-reinforced thermosets for water supply, sewerage, drainage and sewerage; pipes and pipeline parts made of composite materials; containers made of fiber-reinforced thermosetting plastics for compressed or liquefied gases; containers lined with polymer composites for compressed or liquefied gases) ;

- pipes and pipeline parts made of thermoplastics (polyethylene pressure pipes; polyethylene pipes for transporting gaseous fuel; polyethylene sewer pipes and fittings to them; metal-plastic pipes; other polymer rigid pipes; other plastic fittings; other plastic products for sewage (wells));

- construction products made of concrete (concrete paving slabs (paving slabs); concrete free-flow pipes; reinforced concrete free-flow pipes; reinforced concrete pipes for the device by the method of trenchless laying of underground sewer pipelines; reinforced concrete links of culverts under the embankments of roads and railways);

- pipes and pipeline parts made of cast iron (Pipes, fittings, valves and their connections made of nodular cast iron for water and gas supply);

- metal construction products (profiled metal roofing sheets with polymer coating (metal tiles); profiles and similar products made of ferrous metals or aluminum; three-layer metal panels of the "sandwich" type with a mineral wool core);

- glass for architectural and construction purposes (glued glass units for construction (including for structural glazing));

- heat-insulating materials (heat-insulating materials made of polyethylene foam; heat-insulating reflective materials with lining of aluminum foil);

- sanitary fittings (mixing fittings).

In accordance with paragraph 15 of the Rules for the assessment of the regulatory impact of draft normative acts and draft decisions of the Eurasian Economic Commission, approved by the Government of the Russian Federation dated December 17, 2012 No. 1318 (hereinafter - Rules No. 1318), the Department of Metallurgy and Materials of the Ministry of Industry and Trade of Russia is preparing summary report in accordance with the Methodology for assessing the regulatory impact, approved by order of the Ministry of Economic Development of Russia dated May 27, 2013 No. 290 (hereinafter - the Methodology).

In accordance with clauses 3.4.1, 3.4.2 of the Methodology, the developer formulates the causes of the problem requiring the introduction of additional legal regulation, and also assesses the negative effects and consequences of its existence. In addition, the formulation of the problem to be solved by the proposed regulation method should be based on the use of the category of costs (including losses in the form of real damage and lost profits) arising from the participants of the relevant social relations due to its existence.

By virtue of clause 3.4.3 of the Methodology, the problem must be quantified using data from official and (or) other published data that can be verified.

In accordance with clause 3.4.5 of the Methodology, in order to prove the relevance of the problem and quantitatively measure its scale, it is necessary to provide a description of the negative impact and consequences of the existence of this problem, which, among other things, can manifest itself in the presence of unreasonably high costs of applying the established procedures by the parties to the relationship (can be based on comparing the cost and duration of similar procedures in other countries, as well as analyzing applications from citizens and organizations).

In accordance with clause 3.6.1 of the Methodology, when determining the goal of legal regulation, the developer must provide qualitative and quantitative parameters that characterize the result of the introduction of this regulation. The description of the goal should include the formulation of the qualitative result of regulation, as well as indicators of quantitative dynamics that characterize the degree of its achievement over time. These conditions are necessary to ensure the possibility of subsequent monitoring of the effectiveness of the proposed developer of legal regulation. It is important to note that the compliance of the stated regulation goal with the nature of the stated problem is one of the important conditions for choosing the most effective solution to regulate this problem.

According to clauses 3.7.1, 3.7.2 of the Methodology, the developer must consider all possible regulation methods from his point of view, taking into account the possibility of refusal of any intervention. The choice of the best possible method of regulation is carried out by the developer on the basis of a comparison of the total benefits and costs of potential addressees of the legal regulation being developed, as well as an assessment of the corresponding costs (possible receipts) of the budgets of the budgetary system of the Russian Federation.

Additionally, we draw your attention to the fact that in accordance with clause 8.1 of Regulation No. 1318, the draft act should provide for provisions on the abolition of proportionate requirements in the same area of legal regulation in the relevant area of entrepreneurial or other economic activity in accordance with the methodology for assessing the standard costs of subjects of entrepreneurial and other economic activity arising in connection with the fulfillment of regulatory requirements approved by order of the Ministry of Economic Development of Russia dated September 22, 2015 No. 669.

If information is not sent on a separate group of construction products, it will be excluded from the forthcoming draft Resolution of the Government of the Russian Federation.
