The Ministry of Construction of the Russian Federation will support the construction industry in the face of changes in prices for building materials

The Ministry of Construction of Russia has developed a draft federal law "On Amendments to the Federal Law" On the Contractual System in the Procurement of Goods, Works, Services to Meet State and Municipal Needs "(Law No. 44-FZ).

The amendments provided for by the bill apply to government contracts, the subject of which is the performance of construction, reconstruction, overhaul, demolition of a capital construction facility, and preservation of cultural heritage sites. The draft law proposes to establish a new basis for changing the essential conditions of the contract price, which will allow the customer to change the price of contracts concluded for a period of at least one year, without the need to conclude a new contract.

In particular, to such grounds are added cases when during the period of execution of the contract there was a significant change in the value of one or more items of pricing construction resources, which led to a change in the total cost of work by more than 5%, and the execution of the specified contract due to circumstances beyond the control of the parties to the contract without its conditions cannot be changed.

The bill is aimed at supporting the construction industry in a changing economic environment and leveling the consequences, one of which is the increase in prices for construction products. In addition, the bill is aimed at eliminating the impossibility of executing the concluded contracts. This support measure is designed, among other things, to ensure the implementation of capital construction projects created within the framework of national projects.

For example, according to the results of the analysis carried out by the Ministry of Construction of Russia, it was found that an increase in the cost of metal products and structures by 60% leads to an increase in the cost of construction by an average of 5%.

Thanks to the proposed bill, the customer should have the right to amend the terms of the contract in connection with a change in the price of construction products, which will be a significant circumstance. Currently, no such rights are established for the customer by law.

Changes in the value of the contract will be carried out both with a significant increase in the cost of pricing building materials and equipment, and with a decrease in their cost.
