Clarification

By the Decree of the Government of the Russian Federation of June 17, 2017 No. 717, a single list of products, the confirmation of conformity of which is carried out in the form of the adoption of a declaration of conformity, approved by the Decree of the Government of the Russian Federation of December 1, 2009 No. 982, is supplemented by section 2221 "Heat-insulating materials" and section 2364 "Building mixes and solutions".

Information on products subject to mandatory confirmation of compliance with indication of regulatory documents establishing mandatory requirements, as well as codes of the All-Russian Product Classifier by type of economic activity JCPA 2 for each type of product is posted on the official website of Rosstandart on the information and telecommunication Internet at https: //www.gost.ru/portal/gost/home/activity/compliance/requiredcompliance (hereinafter - Information). When referring products to the objects of mandatory conformity must be guided by both the product name and the codes given in the Information. Please note that the mandatory confirmation of conformity in the form of a declaration declaration is subject to products named in a single list, for compliance with the requirements of regulatory documents specified in the Information.

In accordance with the provisions of the Federal Law of December 27, 2002 No. 184-ФЗ “On Technical Regulation”, only products put into circulation in the territory of the Russian Federation can be subject to mandatory compliance confirmation.

Considering that the release into circulation refers to the delivery or importation of products (including dispatch from the manufacturer’s warehouse or shipment without storage) with a view to distributing it in the course of commercial activity on a gratuitous or compensable basis, thermal insulation materials and mortars and mortars, shipped before December 27, 2018 are not subject to mandatory compliance confirmation.

According to the provisions of the Law on Technical Regulation, a declaration of conformity is made on the basis of its own evidence, or on the basis of its own evidence and evidence obtained with the participation of the certification body and / or accredited testing laboratory (center) (hereinafter - the third party).

Considering the above, the norm according to which the declaration of conformity of these products is accepted when the manufacturer (seller) of the research (test) protocol and measurements carried out in the testing laboratory (center) accredited in accordance with the established procedure applies to thermal insulation materials referred to in Section 2221. or a quality system certificate issued by a certification body accredited in the prescribed manner, or a valid certificate of conformity for products issued certification body accredited in the prescribed manner.

In relation to building mixtures and mortars, this norm does not apply, and therefore the declaration of conformity of these products may be made on the basis of the manufacturer’s own evidence.

In connection with the frequent complaints of citizens and organizations producing concrete mixes on the need for mandatory confirmation of conformity of commodity concrete, the Ministry of Industry and Trade of Russia reports that, in accordance with the Information, building mixtures classified by OKPD2 23.63.10.110 and 23.64.10.110 are subject to mandatory declaration of conformity, and for compliance, including GOST 7473-2010 “Concrete mixes. Technical conditions ”, which applies to ready-for-use concrete mixes of heavy, fine-grained and lightweight concrete on cement binders, delivered to the consumer for the construction of monolithic and precast-monolithic structures or used at enterprises for the manufacture of products and precast concrete and reinforced concrete structures.

In this connection, concrete ready for casting (ready-mixed concrete) is subject to mandatory confirmation of conformity in the form of the adoption of a declaration of conformity. Please note that the order of registration of the declaration of compliance is established by order of the Ministry of Economic Development of Russia of November 24, 2014 No. 752 "On approval of the registration of declarations of conformity and the procedure for creating and maintaining a register of declarations of conformity of products included in a single list of products subject to conformity declaration" .

Additionally, we note that in accordance with the national standard of the Russian Federation GOST R 56532-2015 "Conformity assessment. Recommendations for the adoption of a declaration of conformity of products to the established requirements ”, which also determines the procedure for conducting work on the adoption of a declaration of conformity of products included in the unified list approved by Resolution No. 982, depending on the functions performed by the applicant, a declaration of conformity is accepted: by the applicant (person performing the functions of the manufacturer) for a commercially available product or for a batch of products;
the applicant-seller - on the batch of products.
