Obligation to fulfill extended producer responsibility

In pursuance of an order of the Government of the Russian Federation, the Ministry of Natural Resources and Environment of Russia has prepared a draft Concept for Improving the Institute of Extended Responsibility of Manufacturers and Importers of Goods and Services (hereinafter - the Concept), on the basis of which A.I. Fokin presented the draft Federal Law “On Amendments to the Federal Law“ On Production and Consumption Wastes ”(hereinafter - the draft Federal Law).

In accordance with the Concept and the draft Federal Law, it is proposed to assign the obligation to fulfill the extended liability of manufacturers (hereinafter referred to as ROP) in respect of packaging produced in the territory of the Russian Federation to its direct manufacturers, regardless of whether they produce it for packaging third-party goods or for packaging their own product, exempting from this obligation manufacturers of goods in packaging.

It is also planned to oblige packaging manufacturers to ensure 100% disposal of waste from the use of packaging and / or to pay an environmental fee, based on the entire mass of packaging released / imported. When calculating the amount of environmental tax from the mass of the package, the mass of secondary resources used for the production of packaging is excluded.

Currently, the recycling rate for glass containers is 25% of the total amount used by manufacturers of packaging. The environmental tax rate for hollow glass is 2564 rubles. per ton.
