New import substitution measures

Since April 30, 2020, the Government of the Russian Federation imposed a ban on the purchase of 125 foreign industrial goods for state and municipal needs, including for the needs of defense and state security.

The list of products covered by the ban includes:

  • shoes, textiles and clothing;
  • paper and cardboard;
  • some materials (sheet glass, ceramic materials, etc.);
  • hoisting-and-transport equipment (cranes, forklifts, etc.);
  • industrial refrigeration and ventilation equipment;
  • machinery and equipment for agriculture and forestry; metalworking equipment and equipment for stone processing;
  • machinery and equipment for mining and construction (bulldozers, loaders, excavators, etc.);
  • vehicles and equipment (cars, ships, railway locomotives, etc.).

The ban does not apply in cases where there is no domestic producer of goods, and also does not apply to manufacturers from countries belonging to the Eurasian Economic Union (EAEU).

The list of exceptions does not end there; procurement is not covered by the ban:

  • one unit of goods less than 100 thousand rubles.
  • aggregate goods worth less than 1 million rubles. The exception does not apply to shoes, textiles and clothing.
  • spare parts and consumables for already used machine tools of foreign manufacturers from the list.
  • in the interests of the FSO, FSB, SVR, Ministry of Internal Affairs, Ministry of Defense, Office of the President of the Russian Federation. The exception does not apply to shoes, textiles and clothing, cars, trucks and fire engines.
  • vehicles of the Ministry of Internal Affairs to ensure the safety of state security facilities.

In addition, by the following decree, the Government of the Russian Federation fixed a list of 174 foreign manufactured goods that are subject to restrictive measures in the case of purchases for state and municipal needs. Customers must reject all offers for the supply of these goods if at least 2 unique applications have been submitted from different manufacturers. Against restrictive measures, manufacturers from the EAEU member countries do not fall again.

The list of products subject to restrictions includes:

  • paper and cardboard products (notebooks, notebooks, diapers, diapers, etc.);
  • chemicals and products (fertilizers, acids, pigments, dyes, detergents, etc.);
  • rubber and plastic products (tires, tires, pipes, accessories for furniture and vehicles, etc.);
  • cement, metal products (radiators, doors and windows, cartridges, sports firearms, etc.);
  • some machines and equipment (elevators, compressors, pumps, drilling machines, etc.);
  • musical instruments;
  • games and toys;
  • some medical instruments (prostheses, insoles, corsets, etc.);
  • sports grounds for outdoor games.

How to check the country of origin of goods falling under prohibitive and / or restrictive measures? For these purposes, during May, the Ministry of Industry and Trade of the Russian Federation must approve the procedures for the formation and maintenance of two registers - the register of industrial products manufactured in the territory of the Russian Federation, and the register of industrial products produced in the territory of the EAEU Member State.
